NATIONAL JUDICIAL COUNCIL RECOMMENDS THREE JUDGES FOR RETIREMENT OVER FRAUD ALLEGATIONS

BREAKING: Nigeria sacks three top judges for fraud, misconduct

Nigeria’s regulatory body for the judiciary, the National Judicial Council, has recommended the compulsory retirement of three judges following allegations of fraud and other judicial misconduct.
The judges include the Chief Judge of Enugu State, A. I. umezulike; a presiding justice at the Court of Appeal in Kwara State, Mohammed Tsamiya; and Kabiru Auta of the Kano State High Court.
They were sacked by the NJC during the council’s 78th meeting held on September 29.
In a statement made available to journalists on Friday, the Council’s Director of Information; Soji Oye, said Justice Umezulike was accused of abusing his office and mistreating defendants.
The council made its findings against Mr. Umezulike following a petition by a lawyer, Peter Eze.
The findings include the following:
“That the Hon. Chief Judge failed to deliver Judgement in Suit in which final addresses were adopted on 23rd October, 2014, until the 9th day of March, 2015, about 126 days after addresses were adopted.”
The act goes contrary to constitutional provisions that judgement should be delivered within a period of 90 days after adoption of addresses.
The council also said Mr. Umezulike abused his privileges when he ordered the petitioner, Mr. Eze, to be arrested by police officers and brought to court, after an agreement had been reached on a matter before him and judgement entered on terms of settlement.
Mr. Umezulike was also accused of making defamatory statements in public against the petitioner, contrary to Rule 1.3 of the National Judicial Council Revised Code of Conduct for Judicial Officers. 
“That there have been many instances of abuse of Judicial powers, by the Chief Judge, particularly against the two defendants in Suits Nos. E/6/2013 and E/88/2016. The Chief Judge clung to these two suits to remain in his Court, despite all genuine efforts made by the defendants to get the suits transferred to another Court.
“That the Chief Judge sitting at a vantage position of Senior Judicial Officer and Head of Court for that matter, should not have allowed his emotions to dictate his judicial functions to the detriment of the defendants in both suits,” the statement said.
THE APPEAL COURT JUDGE
On his part, Mr. Tsamiya was recommended for retirement for collecting a bribe of N200 million from an applicant to facilitate the processes for his case.
The findings were made following investigations into a petition by a certain Nnamdi Orji against Mr. Tsamiya and three other judges: Husseini Muktar, F. O. Akinbami and J. Y. Tukur.
The petitioner had alleged that the judges made contrasting decisions, in similar cases; in addition to allegations of fraud said to have been perpetrated by Mr. Tsamiya.
The council, in its findings said there was evidence that the petitioner met with Mr. Tsamiya thrice, in his residence in Sokoto, Abuja and Owerri where on each occasion, the judge demanded from the petitioner the sum of N200 million to influence the Court of Appeal Panel in Owerri or risk losing the case.
The council, however, found that there was no evidence of conflicting judgements against Mr. Tsamiya, as the cases referred to were different in content.
It also found that there was no evidence that the petitioner ever met or discussed with the other Justices – Mukhtar, Akinbami and Tukur – in respect of the appeal before them.
“It is in the Light of the foregoing that Hon. Justices Husseini Mukhtar (JCA), F. O. Akinbami(JCA) and J. Y. Tukur(JCA), were exonerated,” the statement said.
THE KANO JUDGE
In the case of Mr. Auta of the High Court of Justice, Kano State, he was recommended to the State Governor, Abdullahi Ganduje, for dismissal for collecting N125 million from the petitioner.
The council said Mr. Auta is to be handed over to the Assistant Inspector-General of Police, Zone 1, Kano, for prosecution. 
He was found to have defrauded the petitioner in many ways, some of which Mr. Auta admitted to police officers.
“The petitioner also made cash payment of N72 million to Mr. Auta in several instalments through his Personal Assistant, Abdullahi Bello,” the statement said.
The payment was to assist a former Chief Justice of Nigeria who had just been appointed to secure accommodation and for the petitioner to be in turn rewarded by the award of some contracts by the said Hon. Chief Justice of Nigeria.
The council said the allegations against the three Judicial Officers constitute misconduct contrary to Section 292 (1) (b) of the 1999 Constitution of the Federal Republic of Nigeria, as amended and subsections of rule Rules 1, 2, 3, 4 13 and 15 of the 2016 Revised Code of Conduct for Judicial Officers.
The judges were suspended pending the approval of their recommendation for retirement.

Why Faleke could not succeed Audu – Supreme Court

The Supreme Court Friday proffered reasons why it upheld the election of Yahaya Bello as Governor of Kogi State.
It said it could not do otherwise because neither James Faleke (running mate to the late Abubakar Audu) nor Idris Wada (the candidate of the People’s Democratic Party – PDP) was qualified to be made governor.
Justice Kudirat Kekere-Ekun, who read the reasons for the lead judgment in the appeal by Faleke, said that the All Progressives Congress (APC) was right in substituting the late Audu with Bello.
She further said the Independent National Electoral Commission (INEC) was also in order to allow the substitution and allowing Bello to inherit the votes scored by the Audu/Faleke joint ticket in the November 21 election.
Justice Kekere-Ekun said since it is the party that contests elections, with candidates as agents, it has power to substitute a deceased candidate once it is done within the law.
She held that Falake was not qualified to be made a replacement for the deceased candidate because he did not obtain nomination form and did not participate in the primary election.
Justic Kekere-Ekun said since there was no return and declaration made by INEC in respect of November 21 election, it was wrong to conclude that the Audu/Faleke ticket had won the election before the December 5 supplementary election.
She said that before the sudden death of Audu, after the November 21 governorship election, INEC had already declared the election inconclusive and that since the election was not completed and the final result issued by INEC, Faleke, as a running mate,could not seek to inherit ‎victory in the election.
In upholding the substitution Audu with Bello, the court said, in the face of the law, Bello was the appropriate substitute having obtained nomination form, taken part in the primary election and came second, as against Faleke who did not meet that condition.
The court further said that by virtue of Section 221 of the Constitution, Bello, having become candidate of APC, and legally sponsored by the party, he was qualified to claim the 240,867 votes earned by the Audu/Faleke ticket on behalf of the party in the November 21 election.
The court further held that by virtue of the provision of Section 221, political parties canvass for votes and are voted for. It added that it was only the candidates duly sponsored by political parties, that can lay claim to the votes earned by the party.

Justice Sylvester Ngwuta, who read the reasons in the lead judgment in the appeal by Wada, said the ex-governorfailed to prove his allegation that the election was held in violation of the Electoral Act.
He also upheld the choice of Bello as a replacement for Audu as against Faleke.
“While Section 36(1) of the Electoral Act (EA) made provision for what should be done in the event of the death of a nominated candidate after the delivery of nomination paper, but before the commencement of the poll, neither the EA (2010) nor the Constitution provided for what to do in the event of the death of a candidate after the commencement of the poll as in the case at hand.

“The death of the original candidate of the 2nd respondent (APC) after the commencement of the poll in November 21st election in Kogi State left a yawning gap in the nation’s electoral process without any provision for filling the gap.
“In the situation such as this, it amounts to abdication of duty for the electoral umpire and the tribunal and court to fold their hands and bemoan the fact that the Legislature failed to do the impossible – providing for all exigencies both in the present and the future in their legislative duties.
“The 2nd respondent and INEC rightly resorted to substitution of the deceased candidate with the 1st respondent (Bello). I think that the decision of this court in Amaechi v. INEC (2008) 5 NWLR (pt. 1080) 227 at 296 encompasses the situation created by the death of the 2nd respondent’s candidate. The decision finds support in Section 221 of the Constitution.

“A political party is an abstraction. It has to canvass for votes through its members as agents, in the same way it contests, wins or loses elections through a candidate it nominates, who acts as its agent.
“There is no provision for independent candidates. The candidate nominated to contest at an election by his party acts as an agent of his party. He is, as it were, an agent of a disclosed principal and as far as third parties are involved, benefits and liabilities accruing to the candidate (as agent) belong to his party (the disclosed principal.
“If an agent (candidate) of the party dies, or withdraws from the contest, the political party can substitute the dead candidate or the candidate, who withdraw from the election with another candidate (agent) subject to the provisions of the Act. There is continuity as the new candidate starts and continues from where the previous candidate stopped. ” the court said.
In resolving the question whether or not Bello contested the election without a running mate, the court held that it could not be said that he ran without a running mate as required under the law.
“Now if the court below (Court of Appeal) did not pronounce on the appellant’s contention that Hon. Faleke was not adopted as the running mate of the 1st respondent, it is because the matter had become academic as the issue of nomination of running mate is not within the jurisdiction of the tribunal and ipso facto, the court below cannot pronounce on it.
“But that notwithstanding, did Hon. Faleke withdraw his nomination in accordance with Section 35 of the Act? The answer is in the negative for the simple reason that the purported withdrawal was wrongly addressed to the 3rd respondent (INEC) and not to the political party that nominated him.
“For all intents and purposes, he remained the running mate to the 1st respondent at all material times,” the court said.‎

At 9 years old, William Maillis is like a lot of other boys his age, enjoying video games, knock-knock jokes, sports and hanging out with friends. But William is no ordinary kid when it comes to academics.

In May, he graduated from high school and is now a college student already working on his own theories of how the universe was created. 


Most other 9-year-olds are in fourth grade.

William, who lives in Penn Township, Pennsylvania, is among the youngest people ever to attend college.

 

He’s currently taking a full slate of classes at Community College of Allegheny County as a way to ease into life as a college student and plans to enroll next fall at Carnegie Mellon University in Pittsburgh, according to his father, Peter Maillis, a Greek Orthodox priest. 


“It doesn’t bother me” being the youngest student in class by far, William tells PEOPLE. “I’m used to it by now.”

William, who wants to study the physics and chemistry of space, earn a doctorate degree and work as an astrophysicist, is at ease tossing around concepts like “displacement of space-time” “singularity” and “pure gravity” as he patiently attempts to explain why black holes aren’t “super massive” as theorized by such other brilliant minds as Albert Einstein and Stephen Hawking.

This took place Wednesday during an exhibition match in Nadal’s native Mallorca. Partnered with a teenager named Simon Solbas, and squaring off against Carlos Moya and John McEnroe, Nadal was on serve when a commotion in the crowd (that would normally halt as play resumes) didn’t stop. And rightfully so.
Nadal stopped, the crowd did too, and mother and daughter were reunited.

All that matters for one Wayne Mark Rooney is that he was on the field and found himself in the right place at the right time to create something positive for Manchester United.
OK, his attempted side-foot volley in the 69th minute was somewhat comical. But Rooney’s un-Midas-like touch did fortuitously find the head of Ibrahimovic for the decisive goal in United’s 1-0 Europa League victory over visiting Zorya Luhansk on Thursday.
And manager Jose Mourinho will take any kind of contribution from Rooney, his demoted captain, even if it’s the accidental assist variety.

A string of listless performances finally led to Rooney being dropped from Man United’s starting lineup last weekend, and the result was not flattering for the 30-year-old. The Red Devils romped to a 4-1 win over defending Premier League champion Leicester City, with Juan Mata flourishing as the primary playmaker and Paul Pogba finally getting to be, well, Paul Pogba, the most expensive soccer player on the planet.
Rooney eventually came on as a substitute against Leicester with the game already decided. This sad state of Rooney continued on Thursday as he took a seat on the bench for the second straight match.
But the circumstances were different when Mourinho brought Rooney on for Jesse Lingard in the 67th minute. With the game still scoreless, Rooney was positioned up top with Ibrahimovic to make something happen and hopefully produce the game-winner. It wasn’t pretty, but Rooney – somehow – succeeded.
Twitter, including Man United’s official account, had fun with the play. Even Rooney himself.


As the old saying goes, sometimes it is better to be lucky than good. Because when you’re Wayne Rooney, aging superstar striker with the rapidly declining skills, you’ll take whatever good fortune you can get in a season that could likely be his last at Old Trafford.

A Syrian rescue worker has been filmed breaking down in tears as he heroically pulled a 30-day-old baby girl from the rubble of a bombed building, in the city of Idlib on Thursday.
White Helmets volunteer Abu Kifah recovered the girl alive after two hours of digging and held her close before the pair were rushed off in an ambulance to one of Syria's horrendously overcrowded hospitals.

At least 11 civilians, including seven children, died during attacks on Idlib, nearby Jarjanaz and central Hama province on Thursday, the Syrian Observatory for Human Rights said.

 The West African country of Ghana has taken invention and creativity to a whole new level with bizarre coffin designs emblematic of the jobs they did in their lifetime.
Crazy coffin designs in the African nation show how the dead have been buried in caskets shaped like a pineapple, a camera and even a beer bottle, to represent their jobs in life. 
As well as work-related coffins, some choose to have theirs shaped like animals, including a lion and even a beetle, to symbolise their clan totems.

The tradition of the custom coffins has developed among Christians in the Greater Accra Region of Ghana since the 1960s. Before that, the special coffins were reserved only for chiefs and priests.
Workers seem capable of fashioning coffins in almost any designs, from planes, to pineapples, milk cartons and even mobile phones.
Photojournalist Christina Czybik, from Hamburg, Germany, captured these images while travelling through Ghana and Togo with King Bansah, Queen Gabi and the royal delegation earlier this month.
Miss Czybik, 37, discovered the tradition of Ghana's fancy coffins while researching her trip and was immediately intrigued.

EDUCATION MINISTER WANTS COMPULSORY RELIGIOUS EDUCATION IN SCHOOLS

The Minister of Education, Malam Adamu Adamu, on Thursday in Abuja urged delegates to the National Council of Education (NCE) to consider making the study of religion compulsory for all students.
This is contained in a statement by Mr Agidike Onu, Information Officer of the ministry, in Abuja on Thursday.
Adamu, who spoke at the 61st Ministerial Session of NCE, said school children should learn religion at least up to the end of senior secondary education.
According to him, such studies will make school children acquire moral and ethics as taught in our religious traditions.
“I urge you to consider making the study of Christian Religious Knowledge compulsory for Christian students and the study of Islamic Religious Knowledge compulsory for Muslim students.
“There is nothing we can give them than to give them character, teach them about their God – the source of all values on which life and peaceful coexistence depends.”
The minister advocated the disarticulation of social studies in the current curriculum and re-introduction of History as a subject.
Adamu said that leaders in the education sector committed “a mistake” by removing history.
“How can we know who we are when we do not know who we are not?

“How can we know what to make of our society when we don’t know how our society is made up?
“How can we hope to make sense of the world when we don’t know our place in it?”
Adamu reiterated the strategic position of the teacher in the achievement of any meaningful progress in education development.
The minister added that conscious efforts were being made by the government on teacher development.
He maintained that providing all other learning facilities and environment without the right quality teacher to drive teaching would amount to a nullity.
Adamu said that teacher development programme had been intensified in the states through the Universal Basic Education Commission.(NAN)

MR IBU RECOUNTS DETAILS OF THE DAY HE ALMOST COMMITTED MURDER

Nollywood comic actor, John Okafor, popularly known as Mr. Ibu, has revealed the terrible experience he had that made him feel like committing murder, for the first time in his life.
He said although he makes a living by having people laugh away their sorrows, he has had cause to be unhappy, even bitter on some occasions, and has also had his fair share of life’s blow, to the extent that he contemplated killing someone.

The chubby actor, in a chat with the Punch said, “It was in 2011. My wife and our 2-year-old son had been kidnapped. After I paid the ransom demanded and they were released by the kidnappers, I returned to Lagos from Enugu.
“Then on January 18, 2011, my son fell ill. The matter was actually between the Paediatric Department of the Lagos University Teaching Hospital, Idi-Araba and me.
“My son was diagnosed with inflammation of the liver. The hospital suggested that he should be scanned. At the same time, I was informed that I could take my son out of the hospital to get the scan done elsewhere.

“But the same people later declined, saying that everything had to be done in the hospital because he was too weak to be taken outside. After a while, I was told that there was no electricity in the hospital.
“When I asked if there was no standby generator, they said there was no fuel in it. I offered to pay for fuel only to be told that the man that operated the generator was not around.
“When I left the place and got back later, the man still had not returned. Then I was advised to write an application and to submit to the admin department. After writing the application, I found that there was nobody to receive and treat it.

“While I was waiting, I was told that my son’s condition required blood transfusion; I did everything possible to ensure that he was given treatment at the hospital, but my efforts were in vain.
“Finally, my son gave up the ghost. Later, one of the doctors came to me and, without even sympathizing with me, asked if I could release my boy’s corpse to him so that they could cut it open and use it to teach medical students
“In that moment, I felt like committing murder for the first time in my life,” Mr. Ibu added.
On a lighter note, the actor spoke further, reminiscing his days as a bachelor.

He said, “I had problems with my relationships with women. Each time I had a new girlfriend; other men would always take her from me. Whenever I fell in love with a girl, somebody would snatch her from me. But I don’t fear any sense of loss because I married the best woman on earth.
“Now that I am happily married, women have not stopped coming to me for a date. That is part of the price I have to pay for being popular.
“They are the ones chasing me. I don’t woo them, though,” the 54-year-old actor quipped.

INEC CONFIRMS ROTIMI AKEREDOLU AS APC GUBER CANDIDATE IN ONDO

The Independent National Electoral Commission, INEC, has released the list of candidates for the November 26 governorship election in Ondo State.
In a list published on Thursday evening, INEC confirmed former President of the Nigerian Bar Association, NBA, Chief Rotimi Akeredolu, as the governorship candidate of the All Progressives Congress, APC.
Akeredolu emerged as APC’s candidate from the party’s primary election that was purportedly marred by electoral irregularities.
Following alleged irregularities that marred the primary on September 3 2016 in Ondo State, the party’s Appeal Committee had recommended the cancellation and conduct of a fresh primary election .
Despite the recommendation of the Appeal Panel, the national leadership of the party submitted Akeredolu’s name to INEC as its governorship candidate.
Meanwhile, INEC also confirmed Eyitayo Jegede as the Peoples Democratic Party, PDP’s candidate in the forthcoming election.
Jegede, a former Attorney General and Commissioner for Justice in Ondo State is of the camp of the factional National Chairman of the party, Ahmed Makarfi.
His confirmation as the party’s candidate may have put an end to the aspiration of Jimoh Ibrahim, the nominee of embattled factional National Chairman of the party, Sen Ali Modu Sheriff.
INEC also cleared no fewer than twenty-eight political parties and their candidates for the forthcoming election in the state.

UNIVERSITY DON CLAIMS EARLY MORNING SEX IS BENEFICIAL TO HEALTH

Prof. Musa Yakubu of University of Ilorin has said that having sex in the early morning lowers blood pressure and reduces risks of heart attack.
Yakubu of the Department of Biochemistry made the assertion in a paper, “Knocking Down the Barriers to Four O’Clock Activities and Reproductive Inadequacies”, presented at the 163rd Inaugural lecture of the university on Friday.

He said that having sexual intercourse, three to four times a week, was good for love life.
“Research has shown that sex boosts immune system by stimulating the body’s first line of defence and production of immunoglobulin A (IgA), against cold and fever,” he said.
The News Agency of Nigeria (NAN) reports that immunoglobulin A is one of the most common antibodies in the body system.

Antibodies are proteins made by the immune system to fight bacteria, viruses, and toxins.
Yakubu said that sex also regulates menstruation in women by influencing the levels of lutenizing hormones that controls menstrual period and promote better sleep.
According to him, the act of sexual intercourse also release the feel-good chemical, known as oxytocin, which enhances closeness with one’s partner and makes people feel happier for a longer period of time.
“Lovemaking of about 20 minutes reduces 150 calories,” he said.
The professor of Biochemistry postulated that sex is the most powerful creative force given to human by God for pleasure and deep companionship.

Yakubu, however, noted that any marriage in which the man or woman could not enjoy sexual intercourse or satisfy their partner in bed was a dead marriage.
He said that lack of sexual satisfaction had led to the collapse of many marriages in Nigeria, and urged couples to seek for solutions to the problem.
“Sexual and reproductive dysfunctions are common among men and women in Nigeria, which necessitates regular screening and check-ups,” he said.
He also said that traditional medicines had been authenticated to cure sexual dysfunctions. (NAN)

PASTOR STUCK INSIDE OGUN SHRINE CLAIMS GOD ASKED HIM TO KEEP QUIET

The presiding pastor of the Ona-Iye branch of Christ Apostolic Church, Wale Fagbere, who was reportedly found motionless in a shrine at Ketu community, Ayetoro, in the Yewa North area of Ogun State, has denied being struck by idols while destroying the shrine.
Fagbere was said to have been stuck in the shrine on September 20, while trying to destroy it. When people in the area found him motionless, they raised alarm and according to reports, the priests of the shrine reluctantly revived him after the traditional ruler, Alaye of Ayetoro, Oba Abdulazeez Adelakun, pleaded with them.

The pastor, who is said to be the son of the late chief of the community, made the denial at a press conference convened by the State Chapter of the Christian Association of Nigeria, CAN.

Fagbere further claimed that he was carrying out a “divine assignment” and was told by God to remain motionless after destroying the shrine, admitting that he was motionless after the assignment.
“God told me that I should go to the shrines to bring out those things for the liberation of Ayetoro. God told me to do three things in the shrines.
“That when I get there, I should evacuate, step aside and watch the film. He said I should not say anything when people come out to see me. So, I did as instructed by God on that day.
“I got there around 5am and after I took out those things, God told me to wait and stay and I did.

“God also told me to keep quiet. It was not their gods that held me.
“When I was taken to the palace, I told them that all my actions were directed by God and not human beings or the church of God.
“Although, they tried many charms on me, none was effective. I am healthy. I followed the instruction of God that I should be quiet and they also know the truth,” he told the gathering of CAN members in the State.
Fagbere claimed he deliberately waited in the shrines for the idol worshipers to see him.

The pastor was later charged with sacrilege and malicious damage, but the idol worshipers withdrew the case.
The Regional Coordinator of Yewa/Awori, Pentecostal Fellowship of Nigeria, PFN, Apostle Lola Dada, disclosed that the idol worshipers demanded that the pastor’s family contributes N300,000, while CAN was asked to pay N200,000, to appease the gods and repair the damage.
Dada, who spoke on behalf of the state’s CAN Chairman, Bishop Tunde Akin-Akinsanya, told newsmen at the occasion, “he [Pastor Fagbere] was handed over to the police and the police charged the case to court.
“The idol worshipers withdrew the case from the court; they said they cannot take the son of their late Oba to court and the case was withdrawn the same day.
“They said it was the church that encouraged him to do what he did. So, the idol worshipers transferred the aggression to the church.
“They barricaded the church with sacrifice and palm fronds, but the Christian youths removed them.
“They asked the family of the pastor to pay N300,000 while CAN should bring N200,000 for the sacrifice to appease their gods, but, no money was given to them and peace has returned to the town.”
